1. Service Description
Career Ladder Builder is a SaaS platform operated by Rovaryn Digital Inc. accessible at app.careerevaluations.com. The marketing website at careerevaluations.com provides information, the ROI calculator, and the digital product store. This agreement covers all three surfaces.
2. Digital Product Purchase Terms
Digital templates (Master Template, Evaluation Scorecard, Competency Library Starter Kit) are delivered as downloadable files immediately after purchase. Due to the digital nature of the products, refunds are not available after download unless the file is defective. Defective files will be replaced or refunded within 5 business days of a support request.
3. SaaS Account Terms
Subscription billing is monthly or annual, charged in advance. Upgrades take effect immediately. Downgrades take effect at the end of the current billing cycle. 14-day free trial available on all plans. No credit card required to start a trial.
4. Acceptable Use
Customers may not use Career Ladder Builder to process, store, or transmit data in violation of applicable law; attempt to gain unauthorized access to other organizations' data; reverse-engineer the platform; or use the platform for purposes other than internal HR career development management.
5. Data Ownership
Customers retain ownership of all career framework definitions, employee data, evaluation records, gap reports, and development action items entered into Career Ladder Builder. Rovaryn Digital Inc. does not claim any ownership over customer-submitted data.
6. Intellectual Property
The Career Ladder Builder software, including competency template content derived from the O*NET database (used under CC BY 4.0), is owned by Rovaryn Digital Inc. O*NET® is a trademark of USDOL/ETA.
7. Liability
Rovaryn Digital Inc. is not liable for indirect, incidental, or consequential damages arising from use of Career Ladder Builder. Total liability is limited to the amount paid in the 12 months preceding the claim.
8. Governing Law
This agreement is governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles.
9. Changes
We may update these terms with 30 days' notice via email to the account Admin address on file.
